Terms of service

The rules of the road for using FastYoke — accounts, acceptable use, SMS messaging, billing, and the standard legal boilerplate.

This is the FastYoke terms of service.

1. Agreement

By creating an account, submitting a form, or otherwise using the Service, you agree to these terms and to the Privacy Notice. If you do not agree, do not use the Service.

If you are accepting these terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to that entity.

2. Eligibility

You must be at least 16 years old to use the Service. The Service is not directed at children under 16, and we do not knowingly collect data from them. See the Privacy Notice for what we do if a child's data reaches us.

3. Accounts

  • You are responsible for the security of your account credentials and for everything done under your account.
  • You must provide accurate registration information and keep it current.
  • You may not share an account between multiple humans; each operator user needs their own login.
  • We may suspend or terminate an account that we reasonably believe is being used in violation of these terms.

4. Acceptable use

You agree not to:

  • Use the Service to send unlawful, fraudulent, harassing, defamatory, or infringing content.
  • Probe, scan, or test the vulnerability of the Service outside our coordinated disclosure process.
  • Circumvent rate limits, quotas, or tier gates.
  • Resell, sublicense, or white-label the Service except under a written agreement with FastYoke.
  • Use the Service to send unsolicited SMS, email, or other electronic communications, or to send any communication to recipients who have not provided opt-in consent.
  • Use the Service to build a competing product or to train machine-learning models on the Service's output.

We may remove content or suspend access without prior notice where required to comply with law, protect the Service or its users, or stop ongoing abuse.

5. SMS / text messaging

If you provide a mobile phone number and opt in — by entering the number and confirming consent during signup, in your account security settings, or during driver / collaborator onboarding — FastYoke may send you transactional SMS messages, including:

  • One-time passcodes for login and two-factor authentication.
  • Account verification and password-reset confirmation codes.
  • Security alerts for new device sign-ins.
  • Job lifecycle notifications (assignments, status changes, delivery confirmations, exception alerts) tied to shipments or workflows you are associated with on a tenant operator's account.

Message frequency is event-driven, not promotional. Standard message and data rates may apply depending on your mobile carrier and plan. Reply STOP to any message to opt out; reply HELP for help. You can also remove your number from your account profile at any time. Opting out does not terminate your account or other (non-SMS) notifications.

Carrier delivery is best-effort. FastYoke is not liable for delayed or undelivered messages, and SMS is not a substitute for any alerting channel where delivery is safety-critical.

6. Tenant operators and end users

FastYoke serves two audiences:

  • Tenant operators — organizations that sign up for a FastYoke tenant and configure workflows, forms, and integrations.
  • End users — people who interact with an operator's forms, jobs, or notifications.

An end user's relationship is primarily with the operator that embedded FastYoke. The operator decides what data is collected, how it is used within their account, and what downstream systems receive it. FastYoke acts as a processor on the operator's behalf for that operator-controlled data. See the Privacy Notice for the data-flow detail.

7. Plans, billing, and tier changes

  • Paid plans bill on a recurring basis (monthly or annually) at the price listed on the pricing page at the time of subscription.
  • Charges are non-refundable except where required by law.
  • We may change pricing on at least 30 days' notice; changes take effect at the start of your next billing cycle.
  • Downgrading a tier may reduce or disable features. You are responsible for exporting data before a downgrade if the target tier does not retain it.
  • Failure to pay may result in suspension and, after a reasonable cure period, termination of your account.

8. Your content

You retain ownership of any data, forms, files, or other content you submit to or generate within the Service ("Your Content"). You grant FastYoke a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and display Your Content solely to operate the Service for you. We do not sell Your Content, share it with advertisers, or use it to train models.

You represent that you have the rights necessary to submit Your Content and that doing so does not violate any law or third-party right.

9. Our intellectual property

The Service — including the platform, the marketing site, the documentation, our trademarks, and the look and feel — is owned by FastYoke and its licensors. These terms do not grant you any right to our trademarks or branding except as needed to use the Service.

The "Powered by FastYoke" badge is provided under a separate permission set documented in the product; you may suppress it on tiers that permit suppression.

10. Third-party services

The Service may integrate with third-party services (payment processors, email/SMS delivery vendors, authentication providers, infrastructure providers). Your use of those integrations may be subject to the third party's own terms. We are not responsible for third-party services, but we choose them with care and disclose the categories in the Privacy Notice.

11. Service availability

We aim for high availability but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance or emergency maintenance that briefly affects the Service. Service-level commitments, where they exist, are governed by the SLA attached to your plan.

12. Termination

You may close your account at any time from the admin console; closure stops future billing and starts the deletion process described in the Privacy Notice.

We may suspend or terminate your access if you materially breach these terms, fail to pay, or use the Service in a way that creates legal, security, or operational risk to FastYoke or its other users. Where practicable, we will give notice and a chance to cure before terminating.

Sections that by their nature should survive termination — accrued payment obligations, content licenses for retained audit logs, disclaimers, liability limits, indemnities, and dispute terms — survive termination.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FASTYOKE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FASTYOKE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.

Some jurisdictions do not allow these limits; in those jurisdictions our liability is limited to the smallest amount permitted by law.

15. Indemnification

You will defend, indemnify, and hold harmless FastYoke and its officers, employees, and agents from and against any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your violation of these terms, (b) your violation of any law or third-party right, or (c) Your Content.

16. Governing law and disputes

These terms are governed by the laws of the jurisdiction in which FastYoke is established, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or related to these terms or the Service is the courts of that jurisdiction, and you consent to the personal jurisdiction of those courts.

17. Changes to these terms

We may update these terms from time to time. When we make material changes, we update the Last updated date at the top of this page and post a notice in the admin console for the next 30 days. Continued use of the Service after a material change takes effect constitutes acceptance of the updated terms. Non-material edits (grammar, typos, broken links) are made silently.
